Ron Newcomb and the Power of the District Attorney General: Why the Appointment Matters

Jul 27
2 min read

The appointment of Tennessee's next District Attorney General is one of the most consequential decisions facing the Fourth Judicial District. The individual selected by Governor Bill Lee will exercise broad authority over criminal prosecutions throughout Cocke, Grainger, Jefferson, and Sevier Counties until voters have the opportunity to elect a District Attorney General in 2028.

The No For Newcomb Campaign believes this appointment deserves careful public attention because of the significant authority vested in the office and concerns the campaign has raised regarding Ron Newcomb, one of the individuals publicly discussed as a potential appointee.

The Authority of a District Attorney General

A District Attorney General has substantial discretion in deciding how criminal cases are handled.

The Tennessee Supreme Court has explained that a district attorney general possesses "virtually unbridled discretion" in determining whether to initiate criminal prosecutions.

Citation: State of Tennessee v. Superior Oil, Inc., 875 S.W.2d 658 (Tenn. 1994).

Among the responsibilities of a District Attorney General are deciding:

  • Whether criminal charges will be filed.

  • Which offenses will be charged.

  • Whether charges should be dismissed.

  • Whether immunity should be granted.

  • Whether plea agreements should be offered.

These decisions can have lasting effects on individuals, families, and communities throughout the district.

Former United States Supreme Court Justice Robert H. Jackson emphasized the importance of prosecutorial authority when he stated:

"The prosecutor has more control over life, liberty, and reputation than any other person in America."

The Campaign's Position

The No For Newcomb Campaign argues that because of the authority entrusted to the office, the next District Attorney General should demonstrate integrity, honesty, ethical leadership, and the confidence of the public.

The campaign contends that Ron Newcomb does not meet those standards and encourages Tennesseans to review publicly available court records, legal filings, judicial opinions, and official documents related to his record before Governor Bill Lee makes an appointment.

The campaign believes the appointment will shape the future of justice in East Tennessee and encourages citizens to become informed participants in the process.

Why Public Participation Matters

Because Jimmy Dunn announced his retirement after the filing deadline for the current election cycle, Tennessee voters will not elect the next District Attorney General until 2028.

Governor Bill Lee will instead appoint someone to serve the remainder of the current term.

The No For Newcomb Campaign encourages citizens to make their voices heard before that appointment is finalized.
